General terms and conditions of sale and use
1. Subject
These General Terms and Conditions of Sale (hereinafter referred to as the «GTCS») govern the sale of products by Delmi Mart via its website. www.pinoy-grocery.com.
2. Acceptance of the GTCS
Any order placed on the site implies unreserved acceptance of these GTC. The customer acknowledges having read them before validating the order.
3. Products
The products sold are foodstuffs dry, No cold chain required. Descriptions and photos are non-contractual but representative. Products are offered while stocks last.
If a product is unavailable after an order has been placed, Delmi Mart will contact the customer to offer an exchange or refund.
4. Awards
All prices are in Euros and include VAT. Delmi Mart reserves the right to modify prices at any time, but products will be invoiced on the basis of the price list in force at the time the order is placed.
5. Control
The customer selects the products, validates their basket and then confirms their order after checking. A confirmation e-mail is sent automatically.
Delmi Mart reserves the right to refuse any abnormal or fraudulent order.
6. Payment
The means of payment accepted are :
Credit card via Stripe (secure payment)
PayPal
Bank transfer
Cash payment on collection (not available for delivery)
Online payments are completely secure and no bank details are stored by Delmi Mart.
7. Delivery
Deliveries are made by DPD to the address given when the order was placed.
Deadlines :
Indicative delivery times are 2 to 5 working days, and may vary depending on the destination.
Follow-up:
A tracking number will be sent to the customer upon dispatch.
Receipt of parcel :
The customer must check the condition of the parcel on delivery.
In the event of a damaged parcel, the customer must make a reservation with the carrier and contact Delmi Mart within 48 hours.
Delmi Mart cannot be held responsible for any errors in the address provided by the customer.
8. On-site collection
Customers may collect their order free of charge from the address indicated when choosing the collection method.
Payment in cash is can only be set back.
9. Right of withdrawal
In accordance with the French Consumer Code, the customer has a period of 14 days in which to exercise his right of withdrawal, with the exception of :
products unsealed after delivery
products whose preservation or hygiene can no longer be guaranteed
The cost of returning the goods is the responsibility of the customer, unless an error has been made by Delmi Mart.
10. Returns & Refunds
The product must be returned in its original packaging, unopened and in perfect condition.
After receipt and verification, Delmi Mart will proceed with the refund within a maximum of 14 days.
11. Guarantee
The products sold are covered by the legal guarantees of conformity and hidden defects. In the event of a defective or non-compliant product, the customer may request a replacement or a refund.
12. Personal data
Personal data is used to manage orders. It is processed in accordance with the confidentiality policy available on the site.
The customer has a right of access, rectification and deletion.
13. Intellectual property rights
All elements of the site are protected by intellectual property law. Any unauthorised reproduction is prohibited.
14. Reservation of ownership
The products remain the property of Delmi Mart until full payment has been received.
15. Force majeure
Delmi Mart cannot be held responsible in the event of unforeseeable and irresistible events preventing the execution of the contract.
16. Applicable law
These GCS are governed by French law. Any dispute will be submitted to the competent courts after an attempt at amicable resolution.
17. Modification of the GTCS
Delmi Mart reserves the right to modify these GTC at any time. The applicable version is that in force at the time of the order.
